Terms of service

The agreement

These terms are an agreement between you and Bitgate, Inc., registered with the Dutch Chamber of Commerce (KvK) under number 66079586, Mastbos 15, 5531 MX Bladel, the Netherlands ("we"), which runs PushPiper. By creating an account or using the API you accept them. If you use PushPiper for an organisation, you accept them on its behalf.

Your account

You need to be at least 16 to use PushPiper. Keep your sign-in, app tokens and team tokens to yourself, and rotate a token if you think it leaked. You're responsible for what your apps send.

Acceptable use

Don't use PushPiper to:

• send messages to people who didn't ask for them, or send spam or advertising nobody signed up for;
• send anything illegal, malicious or infringing, or harass anyone;
• get around quotas or rate limits, probe for vulnerabilities, or overload the service;
• resell the service in a way that hides that it runs on PushPiper.

We may suspend apps or accounts that break these rules, after a warning where that's reasonable. Report abuse to abuse@pushpiper.com.

Plans, payment and cancellation

• The Free plan costs nothing. Paid plans and message packs are listed on the pricing page.
• Payments are processed by Stripe, which acts as merchant of record and handles VAT and sales tax.
• Subscriptions renew automatically each month or year until you cancel. You can cancel anytime from the billing page, and your plan stays active until the end of the period you paid for.
• Team plans start with a 30-day free trial. Members you add during a billing period are prorated.
• Message packs are used after your monthly quota runs out.
• Payments are not refunded for partly used periods or packs, except where the law requires it.
• We announce price changes at least 30 days ahead, and they apply from your next renewal.

Availability

We work hard to deliver every message quickly, but delivery also depends on browsers, push services, networks and your devices. PushPiper comes without an uptime guarantee and must not be your only way to receive alerts where a missed one could put people or property at risk.

Your content and keys

Your messages stay yours. You give us permission to store, process and deliver them only to run the service. Encryption keys live on your devices: we can't recover a lost key or the messages encrypted with it.

Ending the agreement

You can delete your account at any time. We may end or suspend the service for you after serious or repeated breaches of these terms, and we'll give you at least 30 days' notice if we ever shut PushPiper down.

Liability

To the extent the law allows, we aren't liable for indirect or consequential damage, lost profits or lost data, and our total liability is limited to what you paid us in the 12 months before the claim. Nothing here limits liability for intent or gross negligence, or rights that consumers have under mandatory law.

Law and disputes

Dutch law applies to these terms. Disputes go to the competent court for the district of our registered office, unless mandatory consumer law gives you the right to go to a court where you live.

Changes to these terms
